Law & Motion and Discovery

Department 302 is generally closed for lunch at Noon unless the morning calendar runs past Noon, then the staff will recess thereafter. When that happens, a notice will be posted outside the courtroom.

Discovery

  • All Discovery Motions with the exception of Family Law, Probate, and Asbestos Discovery Motions, will be heard at 9 a.m.
  • All Discovery Motions shall be heard in Department 302.
  • Requests for telephonic appearances shall be made pursuant to San Francisco Local Rule 3.4F
  • Family Law Discovery Motions shall be heard by the Family Law Department. Dates for Family Law Discovery Motions shall be set by the Family Law Department at the time of filing.
  • Probate Discovery Motions shall be heard in Probate Department 204. Dates for Probate Discovery Motions shall be set by the Probate Department at the time of filing.
  • Asbestos Discovery Motions shall be heard in Department 503. Reservations for Asbestos Discovery Motions shall be made by calling (415) 551-3706 Monday through Friday (except holidays) between 1:30 and 4 p.m.
  • All motion dates MUST be reserved prior to the filing and serving of moving papers. Call the reservation clerk at (415) 551-3688 Monday through Friday (except holidays) 9 a.m. –Noon.
  • Type the word “Discovery” on the title page of all papers relating to Discovery motions heard in Department 302.

Discovery Ex-Parte Motions

  • Ex-parte motions shall be heard at 11 a.m.
  • All cases will be heard in Department 302.
  • Ex-parte applications for Temporary Restraining Orders, Writs of Attachment, and Writs of Possession must be reserved prior to the filing and service of the moving papers by calling (415) 551-3688. 
  • All other ex-parte Discovery Motions do not need to be reserved prior to filing and service of the moving papers. 

Orders of Examination will be heard in Department 514 at 2 p.m., Monday through Friday.
Civil Pitchess motions will be heard in Department 514 at 9 a.m., every Monday, Tuesday and Thursday only.
 
Law and Motion

  • Hours of operation: Monday through Friday (except holidays) 8:30 a.m. – 4:00 p.m. 
  • All Law & Motion matters (“limited jurisdiction” and “unlimited jurisdiction”), all Writs and Receivers matters and all Petitions for Relief for Service Members shall be heard in Department 302 at 9:30 a.m. on weekdays.

Law & Motion Ex-Parte Motions

  • Ex-parte Motions shall be heard at 11 a.m. with the exception of Unlawful Detainer Stays of Execution.
  • Unlawful Detainer Stays of Execution shall be heard on Tuesdays only. All ex-parte Writs and Receivers must be scheduled with the calendar clerk prior to filing and service of moving papers.
  • For all ex-parte Writs and Receivers call: (415) 551-3720 or (415) 551-3823. 

Courtesy copies of all papers relating to Writs and Receivers ex-parte applications shall be hand-delivered to the appropriate courtroom no later than two (2) hours prior to the hearing (9:15 a.m.).

Presiding Judge Matters

The Presiding Judge of the respective court (or person designated by the Presiding Judge) shall hear all motions that affect trial dates (including all ex-parte applications for Orders Shortening Time for Motion to Continue Trial).

The Presiding Judge of the respective court (or person designated by the Presiding Judge) shall hear all applications for Waiver of Court Fees (“In forma Pauperis”).

The Presiding Judge of the respective court will hear matters that affect Unlawful Detainer trial dates. No matter affecting a trial date will be heard in Department 302.
